As per Article 80 of the constitution, the Rajya Sabha is to consist of maximum 250 members, Out of which 238 are to be elected from States and 12 are to be nominated by the President of India. The actual strength of Rajya Sabha as per present law is Two hundred and forty-five (245), of which 233 members are elected from State and 12 are nominated. Allocation of Seats to the States and Union Territories in Rajya Sabha depends on the population of the State.
